Materialman’s Liens This is a general description of the lien law and should not be construed as legal advice. Since the lien law is strictly construed, and even minor departures from the lien law requirement typically will void a party’s lien rights , we advise you to consult an attorney for any questions regarding your legal rights prior to filing. Acceptance and recording of a lien, does not guarantee the lien is valid. The Real Estate Department cannot cancel and/or remove a lien. The original party that filed the lien must file the cancellation. A mechanic’s or materialman’s lien is a claim created by law against real property and the structures on the property for the purpose of securing priority of payment of the price or value of the work performed and materials furnished in erecting or repairing a building or other structure. O.C.G.A. §44-14-361 http://constructionliens.uslegal.com/state-laws/georgia-lien-law-summary Requirement to be filed The original document must be filed within 90 days from the date of completion of work or the last day materials were furnished. O.C.G.A. §44-14-361.1 Specify the amount claimed State the service rendered Describe the real estate against which the lien is claimed and give the name of the owner(s) of said real estate. Give the date the lien became due. Give proper notice of when the lien expires and of property owner’s right to contest the lien. The law requires specific statutory language to be included in the document and time-sensitive notifications to be sent to the property owner. See O.C.G.A. §44-14-361 . Failure to include proper language shall invalidate the lien and prevent it from being filed. The law specifies who can file materialmen or Labor Liens, §44-14-361 . There are set deadlines for contractors and subcontractors under the Notice of Commencement, §44-14-361.5 . The lien will expire and is void after 395 days from the date of filing if no legal action has been filed, §44-14-367 . Include a return address at the top left corner of each document. Warranty Deed A warranty deed is the most common type of deed used in most purchase and sale transactions. It offers the best protection for the grantee because it guarantees that the title is good and marketable. Quit Claim Deed A Quit Claim Deed transfers ownership interest of the grantor to the grantee without any warranties or guarantees that title is good or that the property is free of liens or claims. Filing Guide To make a change on the deed of a property a new deed must be prepared. Additionally, PT-61 forms are required and available online at www.gsccca.org/file . The form must be completed online, printed and submitted with new deed at time of recording. An attorney or business can prepare the new deed. You can also prepare the new deed yourself, however, please note that Clerk's office cannot give legal advice, nor can we assist in preparing the new deed or PT-61 forms. For your convenience, public computers are available for filing out the PT-61 forms, if needed. Once the form is prepared, the new deed will need to be filed with the Clerk's office. The filing fee is $25.00. Payment of transfer tax is required at time of recording if not exempt. Authority O.C.G.A. §48-6-1; §48-6-2. The PT-61 form that is required to accompany the filing of a Warranty Deed or Quit Claim Deed is only available for completion and printing online at www.gsccca.org. 02 To Whom Do I Make Checks Payable? - Make checks payable to Cherokee County Clerk of Court - No personal checks 03 Do You Accept Credit or Debit Cards? We do take credit cards in the office only. No over the phone payment will be taken. A 3% convenience fee will be added to each credit card transaction. Card holder must be present with valid ID. American Express not accepted. 04 What Is Your Mailing Address? No. All documents must be witnessed and notarized before submitting them to our office for recording. 06 Can I Make a Single Check for The Recording Fee and Taxes Due? When you pay off your home loan, a cancellation of security deed is prepared and recorded by the lender. The Warranty Deed you received shortly after closing remains your ownership deed, unless you recorded a change after the purchase/acquisition. You may print a copy of the Warranty Deed or Cancellation of Security Deed from the county website http://deeds.cherokeega.com/ or on the State website at www.gsccca.org. 13 How do I obtain information on foreclosures? The foreclosure properties that are sold in Cherokee County are advertised in the legal notices section of the Cherokee Tribune, in the Friday edition, for four (4) weeks prior to the sale of the property. Foreclosure properties are sold the first Tuesday of every month between the hours of 10:00 a.m. and 4:00 p.m. on the front steps of the Courthouse. 14 How do I register a business of DBA?
